Terms and Conditions (T&C) for Using the Trimly App

1. Scope

These Terms and Conditions (T&C) apply to the use of the “Trimly” app and all associated services provided by:

These T&C also apply to the use of the app via the Apple App Store, Google Play Store, or other platforms.

2. Subject Matter of the Agreement

Trimly is an app for organizing and booking appointments. Users can create and book appointments with service providers.
Trimly solely provides the technical platform and is neither the provider of the services nor a contracting party for the booked appointments.
A purchase or service contract is established solely between the user and the respective service provider.
Trimly is not responsible for the execution, fulfillment, or quality of the booked appointments.

3. Registration and Use

Registration with name, email, and password is required for certain features. Users are obligated to provide complete and accurate information.
The use of the app for unlawful purposes is prohibited.
Trimly reserves the right to suspend or terminate access in case of violations of these T&C.

4. Appointment Management and Cancellation

Users can cancel booked appointments at any time via the app. Trimly merely provides the technical means to do so.
The responsibility for compliance, changes, or cancellations of the booked appointments lies with the user and the respective service provider.
Trimly assumes no liability for cancellations, no-shows, or changes to appointments by the service provider.

5. Liability

Trimly is liable without limitation only for intent and gross negligence. For simple negligence, Trimly is only liable in cases of breach of essential contractual obligations (cardinal obligations), but limited to the foreseeable, typical damage at the time of contract conclusion.
Trimly is not liable for damages arising from the use of the app or from the content and services of third parties.

6. Data Protection

The processing of personal data is carried out in accordance with our privacy policy, which is accessible in the app and on the website. By using the app, users consent to the processing of their data.

7. Availability of the App

Trimly strives for the uninterrupted availability of the app. However, maintenance work, security or capacity reasons, and events beyond our control may result in temporary interruptions. There is no entitlement to continuous availability.

8. Amendments to the T&C

Trimly reserves the right to amend these T&C where necessary due to legal, technical, or functional changes. Users will be informed of material changes in advance. Continued use of the app after the changes take effect constitutes acceptance of the amended T&C.

9. Governing Law

The law of the Federal Republic of Germany applies. For consumers with habitual residence outside Germany, the mandatory consumer protection provisions of the respective country may also apply.

10. Additional Notes for App Stores

These T&C also apply to the use of the app, as it may be downloaded via the Apple App Store or Google Play Store. Apple and Google are not contractual partners and are not liable for content or damages arising from the use of the app.
